Motion for Obama Contempt in Georgia

Obama Got Served

Obama was served a subpoena to appear in a hearing last week in Georgia over his eligibility to appear on the state’s ballot.  Obama’s attorney, Michael Jablonski, immediately filed a motion to quash the subpoena, which was denied by OSAH Judge Michael Malihi.  In his denial, Judge Malihi seemed to leave open the possibility for a quash, if Jablonski had only offered appropriate legal authority in support.  The judge asserted that “Defendant’s motion suggests that no President should be compelled to attend a Court hearing.  This may be correct.  But Defendant has failed to enlighten the Court with any legal authority.”

Instead of respectfully following procedure, however, Jablonski went over the judge’s head and straight to Secretary of State Brian Kemp with a letter, sent the day before the hearings were scheduled, arguing that the entire matter should be dropped as it was “baseless, costly and unproductive[.]”  Jablonski’s letter concluded: “We await your taking the requested action, and as we do so, we will, of course, suspend further participation in these proceedings, including the hearing scheduled for January 26.”

Kemp responded that his office lacked authority under Georgia law to suspend the hearings, and warned Jablonski that “if you and your client choose to suspend your participation in the OSAH proceedings, please understand that you do so at your own peril.”

Jablonski remained true to his word — neither he nor Obama showed up for the January 26 hearing.  I noted last week that Obama was not scheduled to be anywhere near Atlanta on the date of the hearing, although I had wondered if still, perhaps, Georgia might be on his mind.  According to reports in the blogosphere, the president’s schedule on the morning of the 26th was open, and according to an unnamed source, Obama watched the live feed of the hearings.

Perhaps Obama, as well as the several mainstream media news outlets I spotted at the hearing, were merely watching in hopes that the “crazy birthers” would really do something…well, crazy.  Or unlawful.  In fact, though, it was the president himself and his defense team who were the ones defying the rule of law.

The mainstream media, in lockstep with Obama, reported nothing of the events, in a stunning blackout on a truly historic hearing — one that discussed the eligibility of a sitting president to run for a second term.  And more troubling was the fact that the media failed to acknowledge the even more sensational news — that the president and his defense attorney snubbed an official subpoena.

Today, Attorney Van Irion, on behalf of his client, Georgia resident David Welden, filed a “Motion for Finding of Contempt” with Judge Malihi.  Irion asserts that “… Defendant Obama willfully defied this Court’s order to appear and testify[,]” and his “actions represent a direct threat to the entire judicial branch and the separation of powers between the branches of government.”  Irion argued that “[s]uch a declaration cannot go without response from this Court” and moved that the Court refer the “matter to the Superior Court of Fulton County for confirmation that the Defendant violated Administrative Rules of Procedure … and to determine appropriate sanctions.”

Now, will we get the opportunity to debate the meaning of “subpoena” — or whether the law even applies to this president?

“Charity” Under Threat of Audit is NOT Charity

Every time I hear Obama talk about how the federal government has to “invest” in education, research, etc., and “spend” on the “social safety net” I wonder… Does he think we’re all a bunch of bloodless selfish pr*cks like him?  That we wouldn’t organize locally to take care of our own?  Why can’t the state / counties / towns take care of things?  Why do the Feds have to do everything?

America is great because is America is good.  Obama seems to not believe that.  Listen to him and ask yourself:  Why do you (the Feds) have to do it?  I’m here.  We’re here.  We’ll do it.  Just let us keep our damned money.  If you’re really feeling generous, incentivize us by giving us a tax deduction.  You want efficient use of American dollars to help people?  Match charitable giving.  Every kid who can handle one will get a college education.  Every down & out person will get their “fair shot” locally…

We don’t want your crappy government handouts to be the first stop, we want it to be the last stop you moron!  Don’t you know that?

Wall Street’s “Air-Mail” to OWS

Here is most of a note someone way up in a skyscraper literally dropped, by the dozens, on the filthy OWS crowd and it’s very, very good eatin’! Enjoy! And big, big props to the essential daily read, American Thinker, for posting it!

We are Wall Street.  It’s our job to make money.  Whether it’s a commodity, stock, bond, or some hypothetical piece of fake paper, it’s doesn’t matter.  We would trade baseball cards if it were profitable.

I didn’t hear America complaining when the market was roaring to 14,000 and everyone’s 401k doubled every 3 years.  Just like gambling, its (sic) not a problem until you lose.  I’ve never heard of anyone going to Gamblers Anonymous because they won too much in Vegas.

Well, now the market crapped out, & even though it has come back somewhat, the government and the average Joes are still looking for a scapegoat.  God knows there has to be one for everything.  Well, here we are.

Go ahead and continue to take us down, but you’re only going to hurt yourselves.  What’s going to happen when we can’t find jobs on the Street anymore?  Guess what:  We’re going to take yours.

We get up at 5am & work till 10pm or later.  We’re used to not getting up to pee when we have a position.  We don’t take an hour or more for a lunch break.  We don’t demand a union.  We don’t retire at 50 with a pension.  We eat what we kill, and when the only thing left to eat is on your dinner plates, we’ll eat that.

For years teachers and other unionized labor have had us fooled.  We were too busy working to notice.  Do you really think that we are incapable of teaching 3rd graders and doing ladscapint?  We’re going to take your cushy jobs with tenure and 4 months off a year and whine just like you that we are so-o-o-o underpaid for building the youth of America.  Say goodbye to your overtime and double time and a half.  I’ll be hitting grounders to the high school baseball team for $5k extra a summer, thank you very much.

So now that we’re going to be making $85k a year without upside, Joe Mainstreet is going to have his revenge, right?  Wrong!  Guess what:  we’re going to stop buying the new 80k car, we aren’t going to leave the 35 percent tip at our business dinners anymore.   No more free rides on our backs.  We’re going to landscape our own back yards, wash our cars with a garden hose in our driveways.  Our money was your money.  You spent it.  When our money dries up, so does yours.

Almost Right

While I agree with the whole of the this – yet another brilliant article at American Thinker ‘Palin’s Withdrawal Means Obama Wins’ - I disagree with the headline.  I think the writer underestimates the anti-Obama impulse of the conservative base, no matter how progressive the GOP nominee.  I, for one, will install Mickey Mouse in the Oval Office if it means removing Obama, but for now, while there is hope, I am throwing my support behind Herman Cain, in deed, wallet, and word. (You can set up a recurring donation at his website.  Maybe $25 – or even $50 – out of every payday?  Could you?)
